ArmInfo. The National Assembly of the Republic of Armenia, at its October 28 session, ratified the protocol amending the agreement on the procedure for investigating industrial accidents that occur to workers while they are outside their country of residence.
As Deputy Minister of Labor and Welfare of the Republic of Armenia Lusine Kocharyan noted in her speech, the CIS agreement itself was signed on December 9, 1994, and the protocol on June 5, 2025. The document defines the concept of "occupational accident," which is characterized as an event resulting in an employee sustaining bodily injuries (traumas), including those inflicted by another person, heat stroke, burns, frostbite, drowning, electric shock, lightning, radiation, bites and other bodily injuries inflicted by animals or insects, other representatives of flora and fauna, damage due to explosions, accidents, the destruction of buildings, structures and constructions, natural disasters (earthquakes, landslides, floods, hurricanes, fires, etc.) and other emergency circumstances that entail the need to transfer the employee to another job, temporary or permanent disability, or the death of the employee, if these events occurred in the performance of their work duties, as well as in the implementation of other lawful actions stipulated by the employment relationship with the employer or performed in the employer's interests.
The concepts of "employee" are also established and "employer." In the case of an employee, this refers to a citizen of one of the parties temporarily located in the territory of the other party on a business trip. The employer is an enterprise, institution, organization, regardless of ownership and departmental affiliation, or an individual with whom the employee has an employment relationship in accordance with the legislation of the party of employment.
The document defines the concept of a "business trip" as a trip by an employee, pursuant to a written order from the employer, for a specified period to carry out a work assignment in the territory of the other party.
Upon receipt of information about an accident involving an employee of the other party's enterprise while traveling to and from the business trip destination, including transit, the state body overseeing and monitoring compliance with labor protection legislation of the party in whose territory the accident occurred shall forward the relevant information to the state body overseeing and monitoring compliance with labor protection legislation of the party in whose territory the injured person's employer is located. The investigation of the said accident is carried out by the employer in the manner established by the relevant regulatory acts of the party at the location of the employer. The state body for supervision and control over compliance with labor protection legislation, having received information about the accident that occurred, takes the necessary measures to control the investigation of the accident.
