
ArmInfo. In Armenia, the conduct of criminal procedural actions will be carried out in electronic form. The amendments to the Criminal Procedure Code are discussed at the sitting of the RA National Assembly on February 9 in the first reading.
Presenting the draft, RA Minister of Justice Rustam Badasyan noted that it went through a long stage of discussions - about 10 years, and each time there were reasons for refusing to accept it. Meanwhile, according to the minister, what can be done today should not be left for the future. If we are afraid that we will be mistaken, we should not discuss anything at all. The Minister noted that already on a competitive basis, a company was selected that is developing an electronic program, thanks to which the pre-trial stage will be digitized. Thus, the burden of the pre-trial trial will be alleviated. At present, the public expresses dissatisfaction with the course of a number of court cases, which, in fact, did not begin, since the parties in the classical sense of the word abuse the right. The bill introduces a ban on abuse of law, the application of which leads to lengthy legal proceedings. Now, if the right is abused, a sanction will be applied. In addition, at present, in the presence of voluminous criminal cases and a change of judge, the investigation of the case is being resumed. The innovations provide for the introduction of the idea of a reserve referee. The president of the court appoints a reserve judge who passively oversees the progress of the case, and in the event of a change of judge, the process continues with a reserve judge. At the same time, the prosecutor will bear clear responsibility for criminal cases - their initiation, conduct or suspension, and the investigator - for the preliminary investigation. The role of defenders in the process of investigative actions, who have received the right to present evidence, is increasing. The institution of the presumption of real facts is also being introduced, which to a greater extent concerns cases involving corruption offenses.
