
ArmInfo. Armenian citizens filing claims for non-material damages due to violations of fundamental rights will be able to defer payment of the state fee. The National Assembly Committee on State and Legal Affairs has issued a positive opinion on the amendments to the Law "On State Fees" submitted by the RA government for the second reading.
According to RA Deputy Minister of Justice Anna Karapetyan, the proposed amendments would add a provision to Article 22 of the law deferring payment of the state fee for claims related to rights violations if the investigative body, prosecutor, or court has established the violation as a result of the actions or inactions of state bodies, local government bodies, or their officials. The list of rights is based on the Civil Code of Armenia and includes the right to life, the right not to be subjected to torture, inhuman or degrading treatment or punishment, the right to personal liberty and security of person, and other fundamental rights.
Anna Karapetyan explained that the amendments are aimed at ensuring access to justice. The new mechanism will allow claims for non-material damages to be filed without the need to pay a state fee at the time of filing, simplifying access to the courts, guaranteeing the right to a fair trial, and reducing financial barriers for citizens whose rights have been violated. The adoption of the draft will create a legal basis for a more fair and accessible judicial process, protecting citizens' rights and ensuring their enjoyment without additional financial burdens.
